Purchase Contract
Charlie’s Tribe must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed. Once payment has been received Charlie’s Tribe will confirm that your order has been received by sending an email to the email address you provide. Charlie’s Tribe acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
Charlie’s Tribe is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by email. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.
Withdrawal/Cancellation of the contract by you
You may withdraw your order for goods at any time up to seven working days after you have received the goods. You do not need to give Charlie’s Tribe any reason for withdrawing your order nor will you have to pay any penalty. However, unless the goods were supplied faulty or damaged, you would need to send them back to Charlie’s Tribe return address at your own cost and risk.
Once you have notified Charlie’s Tribe that you are withdrawing your order, the relevant sum debited to Charlie’s Tribe from you will be refunded to you as soon as possible and in any event within 30 days.
Availability of goods
If Charlie’s Tribe has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible by email at the address given by you in your order form and any relevant sums you paid will be refunded to you. The refund will be made as soon as possible and in any event within 30 days of your order. Charlie’s Tribe will not be obliged to offer any additional compensation for disappointment suffered.
We endeavour to bring our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and subject to availability. We update our website as quickly as we can to minimise disappointment. The process of updating the website when goods have sold out at promotional price may take a few hours to update. Please note that the price the goods are offered for tender are as displayed in your online basket.
Prices, Delivery and Payment
Delivery costs are mentioned during the order process. Delivery costs vary with order size and order destinations. All goods will be delivered via the Belgian postal services by regular post. Charlie’s Tribe will arrange priority delivery by courier upon request; the additional cost to be paid by you. We endeavour to post your order within 24 hours after receipt of the payment (with exception of Sundays and holidays). Charlie’s Tribe will post the goods ordered by you to the person and address you give Charlie’s Tribe at the time you make your order. All delivery times quoted on the website are estimates only, based on availability, normal processing and postal services.
We offer 3 methods of payment: payment in advance via electronic bank transfer to Charlie’s Tribe bank account, payment at the time of collecting the goods or through PayPal. In case payment in advance is chosen, the payment transfer has to be done within 7 working days after the order date. During these 7 working days the ordered articles will be reserved for you. In case no payment has been received by Charlie’s Tribe after 7 days, the order will be cancelled and the ordered articles will be placed back in our shop.
Charlie’s Tribe is not responsible for the consequences of incorrect information supplied by you.
Liability
If the goods Charlie’s Tribe delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Charlie’s Tribe shall have no liability to you unless you notify Charlie’s Tribe in writing at Contact Us of the problem within ten working days of the delivery of the goods in question.
If you do not receive goods ordered by you, Charlie’s Tribe shall have no liability to you unless you notify Charlie’s Tribe in writing at Contact Us within 30 days of the date on which the goods were dispatched to you.
If you notify a problem to Charlie’s Tribe under this condition, Charlie’s Tribe only obligation will be, at its option, to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment, unless such method is no longer valid in which case Charlie’s Tribe e-coupons will be issued to the value of the refund due.
Charlie’s Tribe will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to Charlie’s Tribe under these conditions and Charlie’s Tribe shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.
Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.
Gift vouchers
These conditions apply to gift vouchers which have been purchased from Charlie’s Tribe or received from Charlie’s Tribe directly. Gift vouchers can be redeemed on www.charliestribe.com only when an order for goods is placed. If the value of an order exceeds the value of the voucher the balance must be paid by electronic bank transfer to Charlie’s Tribe bank account, payment at the time of collecting the goods or via Paypal. If the full amount of the voucher is not redeemed, ‘Change’ will be given by way of a new voucher. Change vouchers are also subject to these terms and conditions and are additionally not assignable or transferable.
Gift vouchers cannot be used to buy further gift vouchers. Gift vouchers and unused portions expire one year from the date of issue of the original gift voucher. Gift vouchers cannot be redeemed for cash. One or more gift vouchers can be redeemed against an order; however a gift voucher cannot be combined with a promotional voucher or another type of discount voucher.
Force Majeure
Charlie’s Tribe shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
Severability
If any part of these conditions is unenforceable (including any provision in which Charlie’s Tribe excludes its liability to you) the enforceability of any other part of these conditions will not be affected.
Complaints

Governing Law
The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.
Entire Agreement
These terms and conditions, together with the current Charlie’s Tribe website Terms of Use, prices, delivery details and Charlie’s Tribe contact details, set out the whole of our agreement relating to the supply of the goods to you by Charlie’s Tribe. These terms and conditions cannot be varied except in writing signed by a director of Charlie’s Tribe. In particular nothing said by any employee on behalf of Charlie’s Tribe should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by Charlie’s Tribe. Charlie’s Tribe shall have no liability for any such representation being untrue or misleading.
